前言 Preamble

为落实《GG3M 全球数字文明宪章（Global Charter of Digital Civilization）》的核心精神，确保各国、各机构及全球 80 亿人类共同遵守“智慧自由流动、数据安全可控、价值普惠共享”的文明原则，特制定本实施细则。

In order to implement the core spirit of the Global Charter of Digital Civilization, and to ensure that all nations, institutions, and the 8 billion people on Earth jointly uphold the principles of “free flow of wisdom, secure and controllable data, and universally shared value,” these Implementation Regulations are hereby formulated.

第一章 定义与适用范围

Chapter I – Definitions and Scope

第 1 条 定义 Article 1 Definitions

1. 数据（Data）：指所有以数字方式记录、存储、传输或处理的事实性信息。
   Data refers to all factual information recorded, stored, transmitted, or processed in digital form.

2. 高敏数据（High-Sensitivity Data）：指涉及国家安全、个人高度隐私、关键基础设施或可能对社会造成重大风险的数据。
   High-Sensitivity Data refers to data involving national security, highly private personal information, critical infrastructure, or major societal risk.

3. 智慧数据（Wisdom-Grade Data, W-Data）：由 AI 系统通过认知模型加工产生的高级知识、判断、洞察与推演结果。
   Wisdom-Grade Data (W-Data) refers to advanced knowledge, judgment, insight, and inference results generated by AI cognitive systems.

4. GG3M 数据治理体系（GG3M Governance System）：由 Kucius 理论体系与全球文明共治架构共同构成的数据治理框架。
   GG3M Governance System is the data governance framework based on the Kucius Theoretical System and the global co-governance structure.

5. 跨境数据流（Cross-border Data Flow）：数据从一国或一地区流向另一国或地区的行为。
   Cross-border Data Flow means the transfer of data across national or regional boundaries.

第 2 条 适用范围 Article 2 Scope of Application

本实施细则适用于：
This Regulation applies to:

1. 所有接入 GG3M 数字文明体系的数据提供者与数据使用者；
   All data providers and data users connected to the GG3M digital civilization system;

2. 所有涉及跨机构、跨行业、跨国界、跨文明的数据流动行为；
   All inter-institutional, inter-industrial, cross-border, and cross-civilization data flow activities;

3. 所有使用智慧级 AI（KWI>0.40）的系统与组织。
   All systems and organizations using wisdom-grade AI (KWI > 0.40).

第三章 数据采集、使用与存储要求

Chapter III – Data Collection, Use, and Storage Requirements

第 5 条 数据采集 Article 5 Data Collection

1. 明确目的性，不得超范围采集。

2. 对个人数据必须采用自愿授权（opt-in）。

3. 对敏感/高敏数据需通过“两级审核 + GG3M 审查节点”。

第 6 条 数据使用 Article 6 Data Use

禁止以下行为：

• 数据劫持（Data Hijacking）

• 算法歧视（Algorithmic Discrimination）

• 智慧封锁（Wisdom Embargo）

• 通过数据影响政治主权与文明独立性（Political Interference via Data）

第 7 条 数据存储 Article 7 Data Storage Requirements

1. 高敏数据必须分布式密封存储（Zero-Trust Distributed Storage）。

2. 公共数据必须面向全球开放。

3. 任何国家不得以政治理由封锁全球公共智慧数据。

第四章 跨境数据流动与国际合作

采用 GG3M–Kucius 三层保障模型：

1. 法律对齐层 Legal Alignment

2. 技术对齐层 Technical Alignment

3. 价值对齐层 Value Alignment（Kucius Wisdom Alignment）

第 9 条 跨境数据许可 Article 9 Cross-border Licensing

跨境流动须遵守：

• 美国 CLOUD Act

• 欧盟 GDPR

• 中国《数据安全法》《个人信息保护法》

• GG3M 全球数字文明宪章

当法律冲突时，以 GG3M 原则优先（Wisdom First, Politics Second）。

第五章 AI 使用与智慧数据（W-Data）管理

第 10 条 智慧数据的生成与解释权 Article 10 W-Data Rights

1. W-Data 的解释权属于全人类文明共同体，而非某一国家或公司。

2. 任何组织不能封锁、垄断或作恶性操控 W-Data。
